OFFICIAL CONTEST RULES
IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS (“OFFICIAL RULES”) BEFORE ENTERING THE MUSIC UNLOCKED CONTEST (THE “CONTEST”). BY ENTERING THE CONTEST, EACH ENTRANT REPRESENTS THAT THEY SATISFY ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREE TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES AND ALL DECISIONS OF LABATT BREWING COMPANY LIMITED AND ROGERS COMMUNICATIONS INC. (THE “CONTEST SPONSORS”). THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED, OR ADMINISTERED BY OR ASSOCIATED WITH FACEBOOK, INC. OR META PLATFORMS, INC. (COLLECTIVELY, “META”). THE PARTICIPANT, IN ENTERING, IS UNABLE TO HOLD META LIABLE FOR ANYTHING THAT COULD TRANSPIRE DURING THE COURSE OF THE CONTEST.
NO PURCHASE NECESSARY. MUST BE LEGAL DRINKING AGE. CONTEST IS OPEN TO RESIDENTS OF CANADA, EXCLUDING QUEBEC.
HOW TO PLAY
To participate in the Contest, participants must have Internet access and a valid email address and be of legal drinking age in their province or territory of residence. To enter the Contest, entrants must access www.musicunlocked.ca and complete the contest entry form in full, including providing the correct answer to the skill-testing question. Once all mandatory fields have been completed, click submit to enter the contest. Limit of one (1) entry per individual. No other method of entry will be accepted. Entries must be received prior to the Contest Close Date. Entries received after the Contest Close Date are void.
Entries will be stored in a Contest database and will be drawn in accordance with these Official Rules (Contest database and the site at which these Official Rules are published by the Contest Sponsors are referred to collectively as “Contest Website”).
CONTEST PERIOD
The Contest begins on June 13, 2022 at 2.00 PM Eastern Daylight Time (“EDT”) and ends on July 25, 2022 at 2.00 PM EDT (the “Contest Close Date”), after which time no further entries will be accepted.
ELIGIBILITY
The Contest is only open to residents of Canada (excluding Quebec), who are of legal drinking age in their province or territory of residence and who are not employees, contractors, agents, or representatives of the Contest Sponsors or their parent companies, their subsidiaries, affiliates, agencies, distribution companies, the applicable provincial liquor authorities, participating liquor licensees, prize suppliers, the Contest judge, or any person who is domiciled with any of the foregoing persons. The provincial liquor authorities are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever regarding any matter, which relates to this Contest.
If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address by an online service provider, Internet access provider or other organization responsible for assigning the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. An entrant may be required to provide the Contest Sponsor with proof that they are the authorized account holder of the e-mail address associated with the winning entry.
PRIZING
There are (4) prizes available to be won (each a “Prize”). Each Prize consists of tickets to select Live Nation produced and promoted concerts (festivals excluded) scheduled to take place in Canada not to exceed a total amount of $2,500 CAD (“Tickets”). Tickets will be delivered via mobile ticketing and/or placed at will call under the winner’s name at the sole discretion of Live Nation. Tickets are for the sole use of winner and winner must be present to pick up Tickets; valid photo ID will be required. Tickets cannot be transferred or sold. Winner must submit request for Tickets at least thirty (30) days prior to the concert date through a dedicated reservation email address. Tickets are subject to availability, venue capacity, age, and artist restrictions. Tickets to a particular concert are not guaranteed. Ticket quantity for a concert cannot exceed the ticket limit set for the requested concert. Ticket type and seat location is at the sole discretion of Live Nation. Requests for Tickets must be submitted no later than December 31, 2022, after at which time any unused or unclaimed value will be forfeited. Not all concerts listed on www.livenation.com are Live Nation produced concerts. Not valid for private events or rentals. Travel, parking, and accommodations are not included. Winners are responsible for transportation to and from a concert. Winner and guest(s) must abide by all venue policies. Live Nation reserves the right to revoke full or partial Prize from any winner or winner’s guest who it and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any policy or law, and/or may bring the Sponsors, Live Nation, or performers into disrepute. Furthermore, in the event a winner or winner’s guest(s) engage in behavior that, as determined by the Sponsors or Live Nation in their sole discretion, is inappropriate, obnoxious, threatening, illegal or that is intended to annoy, abuse, threaten or harass, victimize, degrade, or intimidate any other individual or group of individuals, including, but not limited to, on the basis of religion, race, ethnicity, sexual orientation, gender, age or disability, or that in any way disparages or adversely affects the reputation, image, and/or goodwill of Live Nation, any performers, or the Sponsors or any of their services, products, trademarks, service marks, or logos, the Sponsors and Live Nation reserve the right to terminate the Prize, in whole or in part, with no further obligation or compensation whatsoever to winner.
By claiming Tickets, the winner and winner’s guest(s) agree to Live Nation’s and to abide by the health and safety measures in effect at the time of any concert, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should a concert be cancelled, winner will be notified as soon as reasonably possible. If a concert is cancelled for any reason whatsoever, Tickets to an alternate concert may be awarded at the discretion of Sponsors or Live Nation. Prize has no cash value and cannot be exchanged for cash or credit, except as required by law. Void if sold or exchanged for compensation. Use of Tickets for unauthorized advertising, marketing or other promotional purposes is strictly prohibited. Resale of Tickets is prohibited.
Odds of winning a Prize depend on the total number of eligible entries received during the Contest Period.
AWARDING OF PRIZES
Four (4) entrants will be randomly selected by the Contest Sponsors or its administrative appointee, Salt Experiential Commerce, Inc. (the “Administrator”), in Toronto, Ontario within 48 hours of the Contest Close Date from among all eligible entries received (the “Draw”). The selected entrants will be notified by the Administrator by email to the email address provided within forty-eight (48) hours following the Draw. The selected entrants must respond to the Administrator by email within seventy-two (72) hours of the timestamp of the email notification by the Administrator to claim the prize. If a selected entrant has not contacted the Administrator as described, another entrant may, at the Contest Sponsors’ sole discretion, be selected by random draw in which case that entrant will become a selected entrant and the previously selected entrant will be disqualified and have no right to the Prize.
CONDITIONS AND RELEASE
Before being declared a winner, the selected entrant(s) must correctly answer, unaided, a mathematical skill-testing question, administered by the Contest Administrator. Before a Prize is awarded, the winner must sign a standard declaration of compliance with the Official Rules and release form(s) releasing Meta, the Contest Sponsors, the Administrator, Live Nation Canada, Inc. (“Live Nation”), performers, the venue(s), Prize provider, and each of their respective directors, officers, employees, representatives, agents, shareholders, parent companies, subsidiaries, professional advisors, successors, assigns, affiliates, provincial liquor authorities and advertising and promotional agencies (collectively, the “Released Parties”) from any and all liability arising out of, pursuant to, or as a result of the carrying out of the Contest, including, without limitation, liability arising from the acceptance of and use of the Prize as awarded, the administration of the Contest, and the selection of a potential winner. By entering the Contest and/or accepting the Prize, the entrant agrees to release and hold harmless the Released Parties from any liability whatsoever and to waive any and all causes of action, for any claims, costs, injuries, losses or damages of any kind arising out of, or in connection with, the Contest or acceptance, possession, or use of the Prize (including without limitation claims, costs, injuries, losses or damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
COLLECTION, USE, AND DISCLOSURE OF PERSONAL INFORMATION
By entering the Contest, you consent to the Contest Sponsors’ and the Administrator’s collection, use, and disclosure of your personal information for purposes of administering the Contest as described in these Official Rules and in accordance with the Administrator’s privacy policy.
Over the course of participating in the Contest, you may be given the option to receive commercial emails or other communications of a commercial nature (collectively, “Commercial Communications”) from the Contest Sponsors or other parties. Should you elect to receive Commercial Communications, your personal information will be used by the Contest Sponsors or the Administrator to that end, in accordance with their privacy policies.
Your personal information may be disclosed to a third party in the following circumstances:
(a) in accordance with these Official Rules, or with your consent, or as otherwise permitted or required by law;
(b) you elect to receive Commercial Communications from a party other than the Contest Sponsors;
(c) to coordinate the fulfillment or provision of the Prize; and/or
(d) if you have been asked to sign and return a Release Form or other documentation in accordance with the terms of these Official Rules, the Contest Sponsors or the Administrator may disclose your personal information to any interested party, such as an entity that is released from liability.
THE DISCLOSURE OF YOUR PERSONAL INFORMATION TO ANOTHER PARTY WILL CAUSE YOUR PERSONAL INFORMATION TO BE SUBJECT TO THAT PARTY’S PRIVACY POLICY AND PRACTICES.
GENERAL
The Prize must be accepted as awarded. The Prize is non-exchangeable, non-transferable, non-refundable, has no cash surrender value and must be accepted as awarded with no substitutions. No substitutions, except by the Contest Sponsors, who reserve the right to substitute any Prize or any portion of the Prize with a prize of equal or greater value. All decisions of the Contest Sponsors and the Administrator are final, and each entrant agrees to abide by all the instructions and decisions of the Contest Sponsors and the Administrator. In the event of any dispute regarding the interpretation of these Official Rules, the decision or interpretation of the Contest Sponsors and the Administrator shall prevail. No communication will be entered into except with selected entrants. All entries become the property of the Contest Sponsors. Any entry that is illegible, incomplete, altered, or contains false information, is invalid. The Contest Sponsors and the Administrator are not responsible for any problems or technical malfunction of Meta or any Internet or telephone network or broadcast transmission during the Contest Period.
LIMITATION OF LIABILITY
The Released Parties shall not be liable for any damages caused or alleged to be caused by or resulting from: (i) any entry, prize or other correspondence or data that is lost, stolen, late, garbled, distorted, delayed, damaged or misdirected for any reason; (ii) any failure, interruption, technical malfunction or delay; (iii) any e-mail, text or other communication sent or received to or from the Contest Sponsor or any of its agents or designees, for any reason; (iv) any incorrect, untimely or inaccurate information, whether caused by the Sites, users or by equipment or programming errors associated with or used in the Contest; (v) any technical or human error which may occur in the processing of any entry or entries in the Contest; for problems with the function of any website or website feature, howsoever caused; (vi) the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data, software, online systems, servers or access providers; (vii) any functionality lost due to not having cookies enabled; (viii) traffic congestion on the Internet; (ix) the security or privacy of information transmitted via computer networks; (x) breaches of privacy due to interference by third party computer “hackers” or for any damage caused to or incurred by any entrant or any other person by reason of any such event or occurrence; or (xi) technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted entries, virus, worm or Trojan Horse damage or any other damage which may limit a participant's ability to participate in the Contest.
ERRORS
The Contest Sponsors are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of winners, or the distribution of any prize.
TERMINATION/MODIFICATION
Subject to applicable municipal, provincial, and federal law, if the Contest is not capable of running as planned for any reason whatsoever, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever beyond the reasonable control of the Released Parties which corrupt or affect the administration, security or proper conduct of this Contest, the Contest Sponsors reserve the right, at their sole discretion to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way.
CONSTRUCTION
Subject to applicable law and these Official Rules, this Contest and the Official Rules shall be governed by Ontario law and all entrants expressly agree that the Ontario courts shall have sole jurisdiction over any dispute or litigation arising from or relating to this Contest and agree to submit to the jurisdiction of the courts of Ontario. The venue of any dispute or litigation shall be Toronto, Ontario. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
DISQUALIFICATIONS:
The Contest Sponsors reserve the right in their sole discretion to disqualify any individual who has:
a) sold or attempted to resell the Prize, in whole or in part;
b) tampered with or attempted to tamper with, or undermined or attempted to undermine, the legitimate operation of the Contest and/or the Contest Website;
c) provided false or misleading information;
d) acted in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any person or to post inappropriate or demeaning material on the Contest Website; and/or
e) otherwise violated these Official Rules.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY ENTRY OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSORS RESERVE THE RIGHT TO DISQUALIFY SUCH ENTRANT OR INDIVIDUAL AND SEEK DAMAGES OR ANY OTHER REMEDY FROM ANY SUCH ENTRANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
SUBJECT TO APPLICABLE LAWS
The Contest is subject to these complete Official Rules and all applicable federal, provincial, and local laws and regulations. By participating in the Contest, you acknowledge that you have read the Official Rules and agree to abide by their terms and by the decisions of the Contest Sponsors, which are final and binding on all matters pertaining to the Contest. You also acknowledge that this Contest is in no way sponsored, endorsed, or administered by, or associated with Meta. All federal, provincial, and local laws and regulations apply. VOID WHERE PROHIBITED BY LAW.
Live Nation is not a sponsor of this Contest and is in no way responsible for the administration of the Contest, or the selection or verification of winners. All inquiries regarding this Contest should be directed to Sponsor or Administrator and not to Live Nation.
LANGUAGE DISCREPANCY
In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control.
