MIKE’S HARD® INTERMISSIONS Contest (the “Contest”)

OFFICIAL CONTEST RULES

IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS ("OFFICIAL RULES") BEFORE ENTERING THE CONTEST. BY ENTERING THE CONTEST, EACH ENTRANT REPRESENTS THAT HE OR SHE SATISFIES ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREES TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES AND ALL DECISIONS OF MIKE’S BEVERAGE CO. (THE “CONTEST SPONSOR”).

THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, TWITTER OR INSTAGRAM. THE PARTICIPANT, IN ENTERING, IS UNABLE TO HOLD TWITTER OR INSTAGRAM LIABLE FOR ANYTHING THAT COULD TRANSPIRE DURING THE COURSE OF THE CONTEST.

THE NATIONAL HOCKEY LEAGUE (“NHL”), ITS MEMBER CLUBS, NHL ENTERPRISES, L.P., NHL ENTERPRISES CANADA, L.P., NHL ENTERPRISES B.V., NHL INTERACTIVE CYBERENTERPRISES, LLC AND EACH OF THEIR RESPECTIVE DIRECT AND INDIRECT SUBSIDIARIES, AFFILIATES, OWNERS, SHAREHOLDERS, OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES AND EMPLOYEES (THE FOREGOING NHL ENTITIES, COLLECTIVELY, THE “NHL ENTITIES”) SHALL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CLAIM ARISING IN CONNECTION WITH PARTICIPATION IN THIS CONTEST OR ANY PRIZE AWARDED. THE NHL ENTITIES HAVE NOT OFFERED OR SPONSORED THIS CONTEST IN ANY WAY.

NO PURCHASE NECESSARY. MUST BE LEGAL DRINKING AGE OR OLDER. CONTEST IS OPEN TO RESIDENTS OF CANADA ONLY, EXCLUDING THE PROVINCE OF QUEBEC.

CONTEST PERIOD
The Contest commences on or about September 8th, 2020 at 5:00PM (EST) and ends on October 5th 2020 at 11:59PM (EST) (the “Contest Close Date”), after which time no further Entries will be accepted.

HOW TO ENTER

Please follow the steps below in order to enter the Contest (See PRIZING section below for prize details) and submit a Contest entry (“Entry”). No other method of entry will be accepted. Limit of one (1) Entry per week per individual per social platform. Entries must be posted during the Contest Period in order to be eligible.

In order to enter the Contest, a participant (the “Entrant”) must:

1) Be of legal drinking age and have a valid Twitter or Instagram account. Participants who do not have a Twitter or Instagram account can visit Twitter.com or Instagram.com, as applicable. Follow the instructions provided to register for a free account.

2) Ensure your Twitter account or Instagram account is set to public.

3) Follow the mike’s hard Canada Official Twitter or Official Instagram Page (www.twitter.com/mikeshardcanada) | (www.instagram.com/mikeshardcanada)

4) Submit a video that showcases your attempt to perform the Mike’s Hard Intermission Game (“Game”) as outlined below under Game Instructions and Entry Schedule and described on the designated Contest post. The video must be under 5 minutes.

5) Include #MikesHardIntermissions in the copy of your video post, and/or DM your submission to mike’s hard Canada Official Twitter or Official Instagram Page .

6) Ensure the video adheres to the Submission Content Guidelines set out below.

7) Ensure that all activities related to the creation of the video and performance of any activity for the video Entry are done in a safe manner, including, but not limited to the following (altogether the “Safety Guidelines”):
a) Making sure the surrounding area where the activity is performed is clear of physical obstructions and safety hazards, including objects and/or people,
b) Following the Game Instructions (defined below) as posted, and not adding any element that may create risk or cause harm
c) Ensuring no person and/or object involved in or exposed to any activity for such video Entry is at risk of personal harm and/or property damage; and
d) Complying with public health and safety guidelines, including COVID safety measures recommended and/or required by applicable the government health authorities, including, but not limited to, making sure participants are of the same household and/or bubble, practicing physical distancing, wearing personal protective equipment when applicable, and avoiding the creation of a situation or scene that would attract people to unnecessarily and unsafely congregate.

All Entries must be in compliance with these Official Rules in order to be eligible.


GAME INSTRUCTIONS AND ENTRY SCHEDULE

1. Week One - [5:00 PM, EST September 8th to 11:59 PM, EST September 13th, 2020]
a. In order to enter Week One’s contest, please ensure you follow @mikeshardcanada on Twitter or Instagram, and submit a video of yourself placing an unbranded plastic cup containing water 6 feet away from you and flipping six (6) ice cubes into the cup with a hockey stick. . One winner from the Week One contest Entries will be selected at random as the Week One winner [see ELIGIBILITY and PRIZING for more details]. All Week One Entries will also be entered into the Grand Prize draw.

2. Week Two – [12:00 AM, EST September 14th to 11:59 PM, EST September 21st, 2020 ]
a. In order to enter Week Two’s contest, please ensure you follow @mikeshardcanada on Twitter or Instagram, and submit a video of yourself placing an unbranded plastic cup containing water 6 feet away from you and flipping ice cubes into the cup with a hockey stick.One winner from the Week Two contest Entries will be selected at random as the Week Two winner [see ELIGIBILITY and PRIZING for more details]. All Week Two Entries will also be entered into the Grand Prize draw.


3. Week Three – [12:00 AM, EST September 22nd to 11:59 PM, EST September 27th, 2020]
a. In order to enter Week Three’s contest, please ensure you follow @mikeshardcanada on Twitter or Instagram, and submit a video of yourself using a hockey stick to weave a lemon through 10 plastic cups set up in a formation.. One winner from the Week Three contest Entries will be selected at random as the Week Three winner [see ELIGIBILTY and PRIZING for more details]. All Week Three Entries will also be entered into the Grand Prize draw.

4. Week Four - [12:00 AM, EST September 28th to 11:59 PM, EST October 3rd, 2020]
a. In order to enter Week Four, please ensure you follow @mikeshardcanada on Twitter or Instagram, and submit a video of yourself trying to say as many hockey puns and slang as possible in one (1) minute. One winner from the Week Four contest Entries will be selected at random as the Week Four winner [see ELIGIBILITY and PRIZING for more details]. All Week Four Entries will also be entered into the Grand Prize draw.


SUBMISSION CONTENT GUIDELINES

Posts/submissions:

1. Must not, in the sole and unfettered discretion of the Contest Sponsor or its administrative appointee (“Administrator”), contain any sexually explicit, disparaging, discriminatory, libelous or other inappropriate content; including, but not limited to, crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, violent, inappropriate or risky behaviour or conduct (including but not limited to the use of alcohol or drugs); personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic);

2. Must contain only content that, in the sole and unfettered discretion of the Administrator, is suitable for all persons;

3. May be submitted only once;

4. Must not have been used for another Contest;

5. Must not contain any copyrighted works (other than as owned by the Entrant, or with all necessary releases and consents as required) nor give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever;

6. Must not contain commercial messages, comparisons or solicitations for products or services; any identifiable third-party products and/or trade-marks, brands or logos;

7. Must not refer to, include, or promote any form of alcohol consumption, nor include any alcohol product, branding, or logos;

8. Must not violate any law, statute, ordinance or regulation;

9. Must not contain any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Administrator in its sole discretion;

10. Must not disparage any of the NHL Entities;

11. Must include only people who are of legal drinking age in their province of residence.

12. Must adhere to the above-mentioned Safety Guidelines

The Contest Sponsor reserves the right to disqualify an Entry and remove a post for any reason whatsoever at its sole discretion.

ELIGIBILITY

The Contest is only open to legal residents of Canada, excluding Quebec, who are of legal drinking age in their province of residence, and who are not employees, contractors, agents or representatives of the Contest Sponsor, the NHL Entities, or their respective parent companies, their subsidiaries, affiliates, agencies, distribution companies, the applicable provincial liquor authorities, participating liquor licensees, prize suppliers, the Contest judge, or any person who is domiciled with any of the foregoing persons. The provincial liquor authorities are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever in regard to any matter, which relates to this Contest.

PRIZING

There are four (4) general prizes available to be won, each consisting of a $500 CAD NHLShop.ca gift card and a mike's hard® branded cooler (each a “General Prize”). Gift card is subject to terms and conditions. The approximate value of each General Prize is $540 CAD.

There is one (1) grand prize available to be won, consisting of a one-year subscription to NHL LIVE™ and an 85” Television (the “Grand Prize”). NHL LIVE™ subscription is subject to terms and conditions. The approximate value of the Grand Prize is $3000 CAD. All Entries from Weeks 1-4 will be submitted into the Grand Prize draw.

The odds of winning a weekly General Prize depend on the number of eligible Entries received for the applicable week (for example, the odds of winning the General Prize for the Week One Contest depends on the number of eligible Entries received in Week One) .
The odds of winning the Grand Prize depend on the number of eligible Entries received during the Contest Period. All prizes must be accepted as awarded. Prizes are non-transferable and non-redeemable for cash. No substitutions, except by the Contest Sponsor, who reserves the right to substitute any and all prizes or any portion of any prizes with a prize of equal or greater value. All decisions of the Contest Sponsor shall be final and shall not be subject to appeal.


AWARDING OF PRIZES

The Contest Sponsor will randomly select a winning Entry on the following dates:

For the Week One Contest General Prize – September 14th, 2020, 11:00 a.m. EST
For the Week Two Contest General Prize – September 24nd, 2020, 11:00 a.m. EST
For the Week Three Contest General Prize – September 28th, 2020, 11:00 a.m. EST
For the Week Four Contest – October 4th, 2020, 11:00 a.m. EST
For the Grand Prize – October 5th, 2020, 11:00 a.m. EST


The selected Entrant will be notified by the Contest Sponsor or Administrator via Twitter or Instagram direct message within ten (10) business days following the end of each weekly Contest draw. The Entrant must then contact the Contest Sponsor by Twitter or Instagram direct message to claim the prize. If the Entrant has not contacted the Contest Sponsor or Administrator within three (3) days of the notification by the Contest Sponsor or Administrator, another Entrant, at the Contest Sponsor’s sole discretion, may be selected and the previously-selected Entrant then will be disqualified and have no right to any prize.

CONDITIONS AND RELEASE

In order to be declared a winner, the selected Entrant must correctly answer, unaided, a mathematical skill-testing question administered at a time and in a manner to be determined by the Contest Sponsor. Before a prize can be awarded, each prize winner verbally consents to a standard declaration of compliance with the Official Rules and release form(s) releasing Instagram, Facebook or Twitter, the Contest Sponsor (including its directors, officers, employees, representatives and agents), the NHL Entities (including each of their respective directors, officers, employees, representatives and agents), their parent companies, subsidiaries, professional advisors, provincial liquor authorities and advertising and promotional agencies (collectively, the "Released Parties") from any and all liability arising out of, pursuant to, or as a result of the carrying out of the Contest, including, without limitation, liability arising from the acceptance of and usage of the prizes as awarded, the administration of the Contest and the selection of a potential winner.

By entering the Contest and/or accepting a prize, the Entrant agrees to release and hold harmless the Released Parties from any liability whatsoever and waive any and all causes of action, for any claims, costs, injuries, losses or damages of any kind arising out of, or in connection with, the Contest or acceptance, possession, or use of any prize (including without limitation claims, costs, injuries, losses or damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

USE OF WINNER'S NAME, LIKENESS, ETC.
By entering the Contest, all Entrants hereby grant to the Contest Sponsor the unlimited right (but not the obligation) to publish and use, without payment or other compensation and without notice, consent or approval, and for the purposes of administration and promotion of this Contest by the Contest Sponsor, any element of the Contest submission Entry, his/her name, photograph and likeness, address (city/town, state, province or territory), voice, and the whole or part of any statement or statements he/she has made or makes about the Contest or a prize in any publicity, program or advertising.

GENERAL

The prizes are non-exchangeable, non-transferable, non-refundable, and must be accepted as awarded with no substitutions. The Contest Sponsor reserves the right, in its sole discretion, to substitute any prize, or a portion thereof, with (a) prize(s) of equivalent or greater value for any reason. The decisions of the Contest Sponsor are final and each Entrant agrees to abide by all of the instructions and decisions of the Contest Sponsor and/or Administrator. In the event of any dispute regarding the interpretation of these Official Rules, the decision or interpretation of the Contest Sponsor and/or the Administrator shall prevail. No communication will be entered into except with selected Entrants. All Entries become the property of the Contest Sponsor. Any entry that is illegible, incomplete, altered, or contains false information, is invalid. Contest Sponsor is not responsible for any problems or technical malfunction of Twitter, Instagram, any Internet or telephone network or broadcast transmission during the Contest Period.

LIMITATION OF LIABILITY

The Released Parties shall not be liable for any damages caused or alleged to be caused by or resulting from: (i) any Entry, prize or other correspondence or data that is lost, stolen, late, garbled, distorted, delayed, damaged or misdirected for any reason; (ii) any failure, interruption, technical malfunction or delay; (iii) any e-mail, text or other communication sent or received to or from the Contest Sponsor or any of its agents or designees, for any reason; (iv) any incorrect, untimely or inaccurate information, whether caused by the sites, users or by equipment or programming errors associated with or utilized in the Contest; (v) any technical or human error which may occur in the processing of any Entry or Entries in the Contest; for problems with the function of any website or website feature, howsoever caused; (vi) the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data, software, online systems, servers or access providers; (vii) any functionality lost due to not having cookies enabled; (viii) traffic congestion on the Internet; (ix) the security or privacy of information transmitted via computer networks; (x) breaches of privacy due to interference by third party computer "hackers" or for any damage caused to or incurred by any Entrant or any other person by reason of any such event or occurrence; or (xi) technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted Entries, virus, worm or Trojan Horse damage or any other damage which may limit a participant's ability to participate in the Contest.

ERRORS

The Contest Sponsor is not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of winners, or the distribution of any prize. The Contest Sponsor reserves the right to terminate this Contest or change these Official Rules at any time, at its sole discretion without notice to participants, subject to approval (where required) by the applicable liquor authorities.

TERMINATION/MODIFICATION

Subject to applicable law, if the Contest is not capable of running as planned for any reason whatsoever, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever beyond the reasonable control of the Released Parties which corrupt or affect the administration, security or proper conduct of this Contest, the Contest Sponsor reserves the right, at its sole discretion to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way.

CONSTRUCTION

Subject to applicable law and these Official Rules, this Contest and the Official Rules shall be governed by Ontario law and all Entrants expressly agree that the Ontario courts shall have sole jurisdiction over any dispute or litigation arising from or relating to this Contest and agree to submit to the jurisdiction of the courts of Ontario. The venue of any dispute or litigation shall be Toronto, Ontario. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

DISQUALIFICATIONS

The Contest Sponsor reserves the right in its sole discretion to disqualify any individual who is found (i) to be tampering with the entry process or the operation of the Contest; (ii) to be acting in violation of the Official Rules; or (iii) to be acting in an un-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person, or to post inappropriate or demeaning material on the web page. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY ENTRY OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH ENTRANT OR INDIVIDUAL AND SEEK DAMAGES OR ANY OTHER REMEDY FROM ANY SUCH ENTRANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

SUBJECT TO APPLICABLE LAWS

The Contest is subject to these complete Official Rules and all applicable federal, provincial and local laws and regulations. By participating in the Contest, you acknowledge that you have read the Official Rules and agree to abide by their terms and by the decisions of the Contest Sponsor, which are final and binding on all matters pertaining to the Contest. You also acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with Twitter or Instagram. All federal, provincial and local laws and regulations apply. VOID WHERE PROHIBITED BY LAW.

RELEASE
All Entrants/participants agree to specifically release and hold harmless the NHL Entities from and against any injuries, losses, damages, claims, actions, and liabilities of any kind resulting or arising from participation in this Contest and/or acceptance, possession, use, misuse or non-use of any prize (including any travel or travel-related activity).
